Privacy Policy

Your privacy is important to us.  As part of our efforts to facilitate and make your experience with the One Spirit Website as user-friendly and enjoyable as possible, we may collect and use certain information you provide to us.  Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in the USER AGREEMENT  and/or the MINISTER AGREEMENT as applicable.

Please review this entire policy to learn the types of End User information One Spirit gathers, how One Spirit uses that End User information, what End User information is disclosed and to what third parties, and how One Spirit safeguards your End User information.  PLEASE REVIEW THIS PRIVACY POLICY AND THE USER AGREEMENT AND/OR THE MINISTER AGREEMENT CAREFULLY.  YOUR USE OF THIS ONE SPIRIT WEBSITE SIGNIFIES YOUR AGREEMENT TO THE TERMS OF THIS PRIVACY POLICY.  

Please also check back periodically as this Privacy Policy may change from time to time. We encourage you to periodically review our Privacy Policy to be sure you are familiar with the most current version.  We will notify you of any material changes by publishing the new Privacy Policy through the One Spirit Website.  The End User information One Spirit gathers is and will be subject to the Privacy Policy in effect at the time the information is gathered.  Should you have any questions or concerns at any time, please feel free to contact us.

By submitting your information to us and by using the Website, One Spirit will assume that you have read, understood, and consent to the Agreement, which includes this Privacy Policy, the User Agreement, and all other applicable One Spirit rules and policies.  We also assume that you consent to One Spirit’s use of your information as described in the User Agreement and/or the Minister Agreement.  If you do not consent, you should not access or use the Website.

IF YOU WISH TO CONNECT WITH A MINISTER THROUGH OUR SERVICE, ANY INFORMATION THAT YOU PROVIDE DIRECTLY TO A PARTICIPATING MINISTER OUTSIDE OF THE ONE SPIRIT WEBSITE WILL BE GOVERNED BY THE TERMS AND CONDITIONS OF THAT PARTICIPATING MINISTER’S OWN PRIVACY POLICY.  PLEASE REFER TO THE PRIVACY POLICY OF THAT PARTICIPATING MINISTER TO DETERMINE HOW THAT PARTICIPATING MINISTER USES THE INFORMATION THAT YOU PROVIDE TO IT.  

User Information that One Spirit Collects

Personal Information and Non-Identifying Information   

When you create an account with us to use the Website, we will ask you for personally identifiable information.  This refers to information about you that can be used to contact or identify you (“Personal Information”).  Personal Information includes, but is not limited to, your full name, phone number, e-mail address, home and business postal addresses, photos of you, and any other information that could be used to personally identify you.  

We also collect other information that you provide as part of registration and the administration and personalization of your account with us that does not identify you (“Non-Identifying Information”).  Non-Identifying Information includes, but is not limited to, your zip code (on its own), gender, age, marital status, religious beliefs, education and employment status, and other individual preferences.  Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified.  But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, your gender only or your viewing preferences).  

We use your Personal Information (in some cases, in conjunction with your Non-Identifying Information) mainly to provide the Website, facilitate and complete transactions for you, facilitate transactions between End Users, and respond to correspondence from you.  We may also use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you.  If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications or update your  account information.  

We may also combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other users to attempt to provide you with a better experience, to improve the quality and value of the Website, and to analyze and understand how the Website is used.

Usage Data

When you visit the Website, whether you are logged in  or just browsing without logging in, our servers automatically record information that your browser sends whenever you visit a website.  Similarly, when you log into the Website using the Mobile App, our services automatically record information that the Mobile App sends.  The information sent automatically by your browser and the Mobile App is referred to as “Usage Data.”  This Usage Data may include information such as the manufacturer and model of your mobile device, your Internet Service Provider (“ISP”); your device’s Internet Protocol (“IP”) address (or other device identifier), browser type, and operating system; referring/exit pages; clickstream data; pages of the Website that you visit, the time spent on those pages or interacting with certain portions of the Mobile App, information you search for on the Website, Website and Mobile App access times and dates; and other statistics.

Usage Data also includes geolocation data.  The Website collects and uses geolocation data to suggest ministers available near your location.  The Website will request your express permission to collect your geolocation data. 

We use this information for technical administration of the Website, including to monitor and analyze use of the Website, to increase the functionality and user-friendliness of the Website, and to better tailor the Website to End Users’ needs.  

Usage Data may be non-identifying or it may be associated with you.  Whenever we associate Usage Data with Personal Information, we will treat it as Personal Information.

How One Spirit Collects Information

One Spirit may use a number of different techniques and technologies to collect Personal Information, Non-Identifying Information, and Usage Data.  For example, One Spirit may use cookies, log files, clear gifs, pixel tags, embedded scripts, and/or other technology used to monitor your use of the Website.

Forms

We and our service providers, as applicable, request certain information from you through the use of forms, such as when you register for an account or use the One Spirit Website to contact a Minister indirectly.  

In order to use many of One Spirit’s features, tools and services, we may ask you to register for an account with your own username and password.  During this User registration process, we may ask you for certain “Personal Information”, including both Personally Identifiable Information and Non-Public Personal Information, such as your first and last name, e-mail address, mailing address, and phone number.  We may also ask for your payment information when enrolling in programs with fees or purchasing items through the Website.   

By using the Service or registering as a User of the One Spirit Website, you agree that One Spirit may provide to you information about Minister services offered by participating Ministers for you to review.   

Log Files

As with most other websites, we collect and use the data contained in log files. The information in the log files include your IP address, your ISP, the browser you used to visit our site, the time you visited our site and which pages you visited throughout our site.  

Cookies

As is regular practice on many websites, the Website uses cookies and other technologies to help us understand which parts of the Website are more popular and how much time users spend there.  A cookie is a small amount of data that is sent to and stored on your device from our server.  Cookies may, for example, allow a user to enter a password less frequently or remember a user’s preferences during an online session.  

The Website uses cookies to determine whether an End User is active and for other business purposes.  The Website may include first-party cookies (i.e., cookies that send data directly to One Spirit and agents and contractors acting on behalf of One Spirit, including cookies used to monitor, analyze, and administer the Website) and third-party cookies (i.e., cookies that send data to our contractors for their commercial use).  The cookies on our Website may also track Internet activity across different websites.  Since cookies are now used as industry standard, most devices automatically accept cookies, but you can usually change your device’s settings to decline them.  If you prefer not to enable cookies, you may choose to disable them; however, please note that certain features on the Website will not be available to you once cookies are disabled.

Usage Data

Usage Data are collected automatically by the Website’s servers and software.  For example, because the Website automatically collects Usage Data for all End Users that visit the Website, your Website session will be tracked. Additionally, the Mobile App collects Usage Data and sends it to the Website servers to facilitate the Services provided to you through the Mobile App.  You agree that we may collect and use technical data and related information, including technical information about your device, system and application software, and peripherals, to facilitate the provision of software updates, product support and other services to you related to the Mobile App. 

Additionally, in some of our e-mail messages, One Spirit may use a “click-through URL” linked to content on the Website.  When an End User clicks onto one of these URLs, the End User will pass through our server before arriving at the destination Web page.  One Spirit tracks this click-through data to help us determine End User interest in certain subject matter and measure the effectiveness of these End User communications.  You can avoid being tracked in this way by not clicking text or graphic links in e-mails from One Spirit.   

Finally, we may use clear gifs or pixel tags, which are tiny graphic images, in order: (i) to advise us of what parts of the Website End Users have visited, (ii) to measure the effectiveness of any searches End Users perform, and (iii) to enable us to send e-mails in a format that End Users can read and tell us whether such e-mails have been opened in order to ensure us that we are sending messages that are of interest to End Users.  

Surveys, Polls and Questionnaires 

One Spirit may offer to you via e-mail online surveys and questionnaires that ask you for Personal Information such as your opinion on various issues and feedback on any Ministers that you have connected with via the One Spirit service.  Occasionally, we may request Personal Information such as demographic information (like zip code, age or gender) when you answer a survey.  Such surveys are completely voluntary.

For the surveys regarding your Minister experience, you may be asked for Personal Information such as how you would rate your overall experience on a five-star system based upon multiple criteria, including Minister features, quality of the Minister, ease of experience, likelihood of recommendation to a friend, why you have decided to use or not use the Minister again, and other potential metrics.  

Tracking

Some Web browsers may be configured to send Do Not Track signals to websites, or users may use similar mechanisms, to indicate a user’s preference that certain web technologies not be used to track the user’s online activity.  The Website, including the Website, does not accept or process such Do Not Track signals or similar mechanisms.   

Messaging

The Website may provide messaging to enable End Users to communicate with one another and/or with One Spirit.  One Spirit may review communications made between End Users using the Website’s messaging for legitimate business purposes, including in the course of customer service investigations regarding End User complaints and disputes between End Users.

Public Communications

Please note that if you use any bulletin board, chat room, comment posting feature, or other public communication service, forum, or feature offered through the Website, or post any information available for viewing by other End Users, any of the information that you share will be visible to other End Users.  The information that you make available can be read, used, and collected by other End Users to send you unsolicited messages outside of the Website.  One Spirit is not responsible for the manner in which the Personal Information that you decide to share will be used by other End Users.

How One Spirit Works and How One Spirit uses the User Information it collects. 

One Spirit uses the Personal Information, Non-Identifying Information, and Usage Data (“User Information”) you provide for several purposes, such as to communicate with you and to give you a better experience when visiting the One Spirit Website by personalizing tools, content, services and e-mail messages. One Spirit will, on occasion, send e-mails to you about the Website or related third-party products or services.  If you do not want to receive e-mail from us, visit the “Opt Out” or “Unsubscribe” link at the bottom of any One Spirit e-mail to remove yourself from continued receipt of such e-mail messages.   

One Spirit also uses User Information to build new services and develop Minister listings that One Spirit believes are more relevant and valuable to you. The User information that One Spirit collects may be added to our databases and used for business purposes, including for marketing and promotional purposes, for a statistical analysis of Users’ behavior, for product development, for content improvement, or to customize the content and layout of the One Spirit Website.  

More specifically, when you register with One Spirit and provide us with Personal Information, including Personal Information and Non-Identifying Information, we provide you with information about our participating Ministers.  You may select from these participating Ministers and inquire as to whether certain Ministers’ services may be made available to you.  Our participating Ministers may receive Personal Information and Non-Identifying Information about you from us in order to determine what Minister services are available to you.  If you request to connect with a selected Minister, One Spirit will provide your name and e-mail address to the selected Minister. The selected Minister will then contact you directly and may request additional Personal Information directly from you in order for you to actually connect with the Minister.    

In addition, the Non-Identifying Information, and Usage Data collected by One Spirit is used to create aggregated portraits of the One Spirit audience, portraits which present anonymous statistical demographic information, but no personal data or Personal Information is linked to it. This aggregated information is used, among other things, to determine trends and needs.  For example, we may create a report that tells advertisers that thirty percent (30%) of our Users are males in a certain age range, so that they can determine which of our products or services are most appropriate for our Users. 

Sharing of Information by One Spirit

One Spirit’s policy is not to share the End User information it collects with third parties other than as specified below, or where an End User expressly consents to our sharing of certain information with a third party.  We may share End User information with third parties under the following circumstances: 

Connecting End Users With Ministers

The Website uses certain information provided by End Users to connect End Users with Ministers.  One Spirit will only share End User information, including name, e-mail address, and any other personal information that the End User has indicated to share with Ministers, with the Ministers that the End User has requested to connect with.   

In particular, if One Spirit discloses your name and e-mail address to participating Ministers when you confirm that you would like to connect with the Minister, the Minister may then contact you.  Please see One Spirit’s Opt-In/Opt-Out Policy below to see your ability to exercise a cost free right to Opt-Out of One Spirit’s sharing of your personal information with Ministers.   PLEASE NOTE THAT, IF YOU PROVIDE ANY PERSONAL INFORMATION DIRECTLY TO THE PARTICIPATING MINISTER ONCE HE OR SHE HAS CONTACTED YOU ABOUT MAKING A CONNECTION, THE PERSONAL INFORMATION THAT YOU PROVIDE DIRECTLY TO THE PARTICIPATING MINISTER IS NOT COVERED BY THIS PRIVACY POLICY, BUT IS COVERED BY THE PRIVACY POLICY OF THE PARTICIPATING MINISTER.   

Facilitating Donations / Contributions to One Spirit

The Website allows End Users to make monetary donations / contributions to One Spirit. Donations handled through the One Spirit website are processed by a third party service provider.  PLEASE NOTE THAT DONATIONS, AND ANY PERSONAL INFORMATION PROVIDED TO THE THIRD PARTY SERVICE PROVIDER, ARE NOT COVERED BY THIS PRIVACY POLICY, BUT ARE COVERED BY THE PRIVACY POLICY OF THE THIRD PARTY SERVICE PROVIDER. 

Connecting End Users

The Website may use certain information provided by End Users to connect End Users with each other.  This may include allowing End Users the ability to invite their friends or to suggest friends or connections through the Website.  

Other Business Partners and Vendors

We work closely with certain business partners and vendors and we may provide End User information to our business partners and vendors so that they can offer or provide services to you.  For example, we may provide End User information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you.  We may also employ third party companies and individuals for any of the following:  to facilitate the Website; to provide the Website or portions of the Website on our behalf; to accept and process payments through the Website; to perform related services, including without limitation, maintenance services, database management, fulfillment, web analytics, and improvement of the features or functionality; or to assist us in analyzing how the Website is being used.  One Spirit will share only the information necessary for its service providers to provide its services to One Spirit. No mobile phone information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

While we attempt to connect with service providers who protect the privacy of its client’s data, One Spirit does not control the privacy policies of its third party service providers.  We encourage you to learn more about the online privacy and data security policies of third party service providers directly from such third parties, as their policies may differ from ours.  You may contact us at any time to learn more about our current service providers. 

Under certain circumstances, you may avoid having One Spirit share your information with its business partners and vendors by not granting One Spirit permission to share your information.  Not granting One Spirit permission to share your information with its business partners or vendors may limit your access to their services through the Website.  

Promotions

From time to time, we may offer promotions through the Website that require a separate registration.  By participating in such a promotion, you agree to the official rules for the promotion, which may require that you provide certain information.  Information collected in connection with a promotion will be used consistently with the promotion’s official rules and this Privacy Policy.

Business Transfers

As we continue to develop our business, we may buy, sell, or share assets in connection with, for example, a merger, acquisition, reorganization, sale of assets, or bankruptcy.  In such transactions, information about End Users generally is often a transferred business asset.  In the event that One Spirit itself or substantially all of One Spirit’s assets are acquired, information about our End Users may be one of the transferred assets. No mobile phone information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Compliance with Law and Protection of One Spirit and Others

We may release End User information when we believe, in our sole discretion, that release is appropriate: to comply with the law, including but not limited to, in response to a subpoena served on One Spirit; to enforce or apply the Agreement, including the User Agreement and other agreements, rules, and policies; to protect the rights, property, or safety of One Spirit, our End Users, or others; or to prevent activity that we believe, in our sole discretion, may be or may become illegal, unethical, or legally actionable (including exchanging End User information with other companies and organizations for fraud protection).

Aggregate Site Use Information  

We may release aggregate End User information (without revealing any Personal Information about you) to advertisers and other third parties in order to promote or describe use of the Website.

Transfer of Data from Minister to One Spirit.   

BY ASKING TO CONNECT TO A MINISTER THROUGH THE ONE SPIRIT WEBSITE, THE END USER ALSO AGREES THAT THE RELEVANT MINISTER MAY NOTIFY, AND OTHERWISE TRANSFER INFORMATION TO, ONE SPIRIT REGARDING THE EXTENT OF THE ENSUING MINISTER- END USER RELATIONSHIP, INCLUDING WHETHER THE END USER FOLLOWED UP ON THE INITIAL REQUEST TO CONNECT WITH THE MINISTER, WHETHER THE END USER REQUESTED ONE-TIME MEETING OR ONGOING MEETINGS, THE OVERALL SATISFACTION WITH CONNECTIONS MADE THROUGH ONE SPIRIT, ETC.  

One Spirit’s Opt-in/Opt-out Policy.

By registering as an End User of the One Spirit Service, you agree that One Spirit may (i) provide to you for your review postings of participating Ministers; (ii) provide to participating Ministers your “Non-Public Personal Information” when you have inquired about a Minister and your name and e-mail address when you have confirmed that you would like connect with a selected Minister; (iii) contact you in the event of a change in the User Agreement, including this Privacy Policy, or to provide you with any Service related notices; and (iv) otherwise provide to you information directly from participating Ministers in instances where you have specifically “opted-in” to receive it. 

For purposes of this Privacy Policy, “opt-in” is generally defined as any affirmative action by a One Spirit End User to submit or receive information, as the case may be.

We currently provide the following “Opt-Out Opportunities”: 

  1. At any time, you can follow a link provided in every offer, newsletter or e-mail message (except for e-commerce confirmation or service notice e-mails) received from One Spirit to unsubscribe from the Service.     

  2. At any time, you can contact us through Info@1spirit.org or the address or telephone number referenced in Section 13 below to unsubscribe from the Service and opt-out of our right per your consent under the terms of this Privacy Policy to share your Personal Information with participating Ministers as described in this Privacy Policy.  

Notwithstanding anything else in this Privacy Policy, please note that One Spirit always reserves the right to contact you in the event of a change in the User Agreement, including this Privacy Policy, or to provide you with any Service related notices. 

At any time, you can “opt-out” of the Service by exercising one of the “Opt-Out” Opportunities” described above and One Spirit will not share any “Personal Information” about you with participating Ministers at any time after the time that you have opted-out.  In addition, if you “opt-out”, One Spirit will request that each of its third-party participating Ministers delete from their servers the name and e-mail that they have obtained from One Spirit in order to contact you after your confirmation of interest in connecting with a Minister made available through our Services; HOWEVER, AGAIN, PLEASE NOTE THAT, in any case where (A)(i) you have inquired about a Minister, and (ii) such third-party participating Minister has allowed users to contact them directly, and (B) One Spirit has provided the participating Minister with your name and e-mail address to contact you, any information that you then choose to provide directly to that participating Minister will be subject to that party’s privacy policy and not One Spirit’s Privacy Policy.   

If you have additional questions about how one of our participating Ministers uses information about you, we urge you to contact them directly. 

California Users. In addition to the ability to utilize the Opt-Out Opportunities described above, California Users may have the right to request certain disclosure information annually from One Spirit.  Such disclosure requests should be directed to: OneSpirit, 247 West 36th Street, 6th Floor, New York, NY 10018.  For more information, please reference the Cal. Civ. Code § 1798.83, available at http://oag.ca.gov/privacy/privacy-laws. In addition, if you are a California resident, in accordance with Cal. Civ. Code § 1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

United States Website; International Transfer.

Please note that the One Spirit Website is based in the United States and is hosted on servers located in the United States.  If you use the One Spirit Website or services from outside the United States, please note that your information may be transferred to and maintained on computers and servers located outside of your state, province, country, or other governmental jurisdiction, where privacy laws may not be as protective as those in your jurisdiction. Your consent to the User Agreement and Privacy Policy followed by your submission of information to One Spirit represents your agreement to the transfer of such information to the United States and the handling of your information consistent with the User Agreement and the Privacy Policy and applicable United States law.  Please note that we do not represent or warrant that the One Spirit Website is appropriate for use in any particular jurisdiction.

Changing or Deleting Your Information 

All End Users who have created an account on the One Spirit Website may review, update, correct or delete the Personal Information in their registration profile by contacting us.  If you completely delete all such information, then your account may become deactivated.  We may retain an archived copy of your records as required by law or for legitimate business purposes. 

Third Party Links

This Privacy Policy applies only to the One Spirit Website.  This Privacy Policy does not apply to any websites managed, maintained, and/or hosted by third parties not directly affiliated with One Spirit that you may visit, e.g., via a link provided through the One Spirit Website, such as a Minister Website or a website maintained by any third party.  One Spirit does not control the privacy policies of other websites to which we may provide hyperlinks.  We encourage you to learn more about the online privacy and data security policies of third party websites directly from such third parties, as their policies may differ from ours. 

How We Protect and Secure Your Personal Information

We are very concerned with safeguarding your information.  We employ administrative, physical, and electronic measures designed to protect your information from unauthorized access.  For example, we use commercially reasonable security measures such as encryption, firewalls, and secure socket layers (SSL) to protect End User information. 

We exercise reasonable care in providing secure transmission of your Personal Information from your device to our servers and ensuring the security of your information on our systems.  For example, One Spirit uses industry-standard tools, such as firewalls and encryption, in an attempt to make your information secure and confidential.  Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we take steps to protect your information, One Spirit can’t ensure or warrant the security of any Personal Information you transmit to us or from our online products or services, and you do so entirely at your own risk.   

We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to you via e-mail or conspicuous posting through the One Spirit Website in the most expedient time possible and without unreasonable delay, as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system. 

Children’s Privacy

We are committed to protecting the privacy of children.  Under the terms of the User Agreement, End Users must be at least eighteen (18) years of age to access and use the One Spirit Website.  Any access to or use of the One Spirit Website by anyone under the age of eighteen (18) is unauthorized, unlicensed, and in violation of the Agreement.  By using the One Spirit Website, you represent and warrant that you are eighteen (18) years of age or older and that you agree to and agree to abide by all of the terms and conditions of the User Agreement.  If One Spirit believes that you are under the age of eighteen (18)  or that you are not old enough to consent to and be legally bound by the Agreement, One Spirit may, at any time, in its sole discretion, and with or without notice: (i) terminate your access to or use of the One Spirit Website (or any portion, aspect, or feature of them), or (ii) delete any content or information that you have posted through the One Spirit Website.
